TERMS AND CONDITIONS

General Terms and Conditions applicable for the e-shop of NetDesign, s.r.o. Czech Republic, which further define and clarify the rights and obligations of the seller and customers (buyers).

1. Ordering goods

Orders are accepted as direct orders from the NetDesign, s.r.o. e-shop at www.ultraeverdry-store.eu. For an order to be valid, all the requisite details must be completed in the e-shop order form. An order also constitutes a draft purchase contract and is binding for both parties. Orders from buyer are considered received and valid upon receipt of a confirmation e-mail from the seller. The delivery destination for the goods is the address specified by the buyer in the order form. The seller reserves the right to cancel an order if unable to supply the goods in the quantity required. By placing an order the buyer confirms that he or she has read the claims procedure and accepts the seller’s General Terms and Conditions governing the delivery of the goods, which are binding for both parties. The ownership right to the goods passes to the buyer upon receipt, provided that the purchase price has been paid.

2. Prices

The price applicable is that stated in the price list the instant the purchase contract is concluded (when the order is sent). All prices are listed excluding VAT and including VAT. The cost of postage and packing is added.

Price of postage and packing for European Union countries (except Cyprus and Malta):
Total 0,5 – 4,5 liters of ULTRA EVER DRY: 26 € (31,46 € incl. VAT)
Total 5 liters and more of ULTRA EVER DRY:  FREE OF CHARGE

3. Delivery of the goods and payment method

Orders are dispatched as soon as possible after the payment has been credited to the seller’s account, no later than within 7 calendar days. The e-shop operator reserves the right to extend the delivery time in the case of unforeseen circumstances. The customer will be informed immediately by e-mail or telephone if the delivery time is to be extended. The operator reserves the right to deliver the entire order in volume packages that differ from those ordered. However, this may not affect the stated price. An order may only be delivered in parts with the consent of both the buyer and the seller.

At present, orders may only be paid for as follows:

a) By bank transfer prior to delivery of the goods.
b) By PayPal or Credit Cards with PayPal prior to delivery of the goods (only for EU customers and only up to 1.000 €).

The buyer will receive an e-mail with instructions for payment (VAT payers in the EU will be billed excluding VAT); the goods will be dispatched as soon as possible after the payment has been credited to the seller’s account.

4. Replacement of goods

Goods may be replaced by the seller within 14 days of receipt by the buyer. The goods must be sent by registered mail and insured. Goods returned must not be used, damaged or otherwise impaired and must be in the original undamaged packaging. If all these conditions are fulfilled, the seller will send new goods within 30 days. All costs associated with replacing the goods, including transport costs, are paid by the seller.

5. Right to cancel a purchase contract

Pursuant to paragraph 6 of the amendment to Act No. 367/2000 Coll., the Civil Code, the buyer has the right to withdraw from the contract without stating the reason within 14 days of receiving the goods. The withdrawal may have following forms:

a) Letter delivered to the address of NetDesign, s.r.o. Kosmova 342/10, 460 14 Liberec 13, Czech Republic.
b) E-mail received at the address  store@ultraeverdry-store.eu .
c) Re-consignment to the address of NetDesign, s.r.o. Kosmova 342/10, 460 14 Liberec 13, Czech Republic.

The goods may not be used, damaged or otherwise impaired and must be in the original undamaged packaging. The 14-day deadline commences on the day the goods are received. The goods must be sent by registered mail and insured. If all these conditions are fulfilled, the seller will return the entire purchase price, including transport costs, to the buyer’s account within 30 days of the buyer withdrawing from the contract. Fees charged for transferring – refunding the money will be paid by the seller.

The seller reserves the right to cancel an order or part of an order in the following cases:

a) The goods are no longer produced or supplied.
b) The goods supplier’s price has changed considerably. In such a case the buyer will be contacted immediately to agree on how to proceed.

The seller reserves the right to change the prices. The prices are confirmed the instant the order is confirmed. If the applicable price is the same or lower than the price stated in the written, fax or e-mail order, no confirmation will be sent to the buyer and the goods will be delivered at the applicable price as soon as the order is received. If the price is higher than the price stated in the order, the seller will immediately notify the buyer, who may accept or reject the new price. With verbal or telephone orders the buyer is always informed of the price applicable for that order.

6. Claims

Any claims will be dealt with by the seller in accordance with the laws in force in the Czech Republic. The buyer is obliged to check the goods upon receipt and report any defects without delay. We are not liable for defects caused by the carrier. When a claim is filed, the goods in question must be returned in the original packaging with a copy of the receipt and a description of the defect. Claims conditions are governed by the applicable claims rules of NetDesign, s.r.o.

8. Protection of the buyer’s personal dat

The seller will keep data on the buyer confidential and will prevent any misuse. All such data will be used solely for receiving, processing and billing orders and will not be processed for any other purpose.

9. Validity of the General Terms and Conditions

The General Terms and Conditions applicable for the NetDesign, s.r.o. e-shop are valid as of 1.12.2013. They are governed by the provisions of the Civil Code, Act No. 40/1964 Coll., or the Commercial Code, Act No. 513/1991 Coll., and Act No. 634/1992 Coll., the Consumer Protection Act, as amended.
